The introduction of the new Civil Procedure Rules, 2002 mandated the requirement that all applications being made for a Grant of Letters of Administration by persons other than the Administrator-General for Jamaica must be accompanied by the Certificate of the Administrator-General.
Where the deceased died intestate (that is, without leaving a valid will), no person is in control of the estate until the Court appoints a Personal Representative by issuing a Grant of Letters of Administration.The Intestates ’ Estates and Property Charges Act and Rule 68.18 of the Civil Procedure Rule 2002 sets out the order of priority for potential applicants.
